Amen. For me, that's it, and that's that....
When we, New Testament believers, consider this part of the Law, imho, we should keep in mind also that to this day in Judaism:
- The decision to divorce is up to the man, and only to the man
- The "get" (letter of divorce) still has to be handed to the wife by the husband.
- The only right she has is to not take it....
- A civil divorce does not dissolve a marriage, according to the Law
- A lot of men choose not to give the "get" that would completely free the woman of moving on with her life, often just out of spite.
- In that case, the woman (agunah), if she is observant, is left with a never ending agony, spiritually and otherwise
- The scholars are actually trying to find ways to set them free, since they are aware of the unfairness of the situation.
- However, that awareness still does not allow them to "break the law" which completely forbids to force the husband to give the "get".
- Some "beit din" have been set up in order to deal with those issue, and some of them (in New York, for example) chose to go ahead and grant the divorce. Of course, what they do is not "recognised".
- The procedures are different in the land of Israel and outside of the land of Israel. In other words, the final decision belongs to the religious court in Israel.
- There is a recorded story, in modern days, of a husband who refused to give a "get" to his wife and, through creative means, the religious court found a way to send him to jail because of it, without breaking the Law.
The man refused to give the "get" for thirty years, at which time he died..... And no, it is not a happy ending....
- The bottom line is, a man has the right to divorce his wife, and not just for adultery, a woman doesn't, according to the Law.
- Even the scholars admit that they don't know why this law was written this way. But, it is in the Torah, and they will abide by it.
